1. Acceptance of Terms
By accessing or using NexGen Jobs ("the Platform"), you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. Your continued use of the Platform constitutes acceptance of any updated terms.
2. Eligibility
You must be at least 18 years old to use NexGen Jobs. By using our platform, you represent and warrant that you have the legal capacity to enter into a binding agreement and meet all eligibility requirements. Users under 18 are prohibited from creating accounts or using our services.
3. User Account and Responsibilities
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
- Not share your account credentials with others
- Not create multiple accounts for fraudulent purposes
You are solely responsible for maintaining the security of your account. We are not liable for any losses resulting from unauthorized account access.
4. Prohibited Activities
You agree NOT to use the Platform to:
- Post false, misleading, or fraudulent job listings or applications
- Upload malicious code, viruses, or harmful software
- Harass, abuse, threaten, or discriminate against other users
- Scrape, data mine, or extract content without authorization
- Impersonate any person or entity, or misrepresent your affiliation
- Violate any applicable laws, regulations, or third-party rights
- Spam users with unsolicited messages or advertisements
- Use automated systems (bots) to access the Platform without permission
- Collect personal information of other users without consent
- Engage in any activity that disrupts or interferes with our services
5. Job Listings and Applications
For Employers:
- You are responsible for the accuracy and legality of all job postings
- Job listings must not discriminate based on race, gender, age, religion, or other protected characteristics
- You must comply with all employment laws and regulations
- You agree to handle applicant data responsibly and in accordance with privacy laws
For Job Seekers:
- Resume and profile information must be truthful and accurate
- You grant employers permission to review your applications and contact you
- You are responsible for your own job search decisions and employment agreements
6. Intellectual Property Rights
All content, features, functionality, logos, trademarks, and materials on NexGen Jobs are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, distribute, or reproduce any part of the Platform without permission
- Use our branding, logos, or trademarks without written authorization
- Create derivative works based on our content
- Reverse engineer or attempt to extract source code
You retain ownership of content you submit (resumes, applications), but grant us a license to use, display, and process such content to provide our services.
7. Account Suspension and Termination
We reserve the right to suspend, disable, or terminate your account at any time, with or without notice, if you:
- Violate these Terms of Service or our policies
- Engage in fraudulent, abusive, or harmful behavior
- Provide false or misleading information
- Damage the reputation or operations of our Platform
- Fail to comply with applicable laws
You may terminate your account at any time through your account settings. Upon termination, your access to the Platform will cease, but certain provisions of these Terms will survive (e.g., intellectual property, limitations of liability).
8. Disclaimers and Limitation of Liability
Service "As Is": NexGen Jobs is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, accuracy, or availability of our services.
No Employment Guarantee: We do not guarantee job placements, interviews, or employment outcomes. The Platform facilitates connections between employers and job seekers but does not control hiring decisions.
Third-Party Content: We are not responsible for the accuracy or legality of content posted by users, including job listings and applications.
Limitation of Liability: To the maximum extent permitted by law, NexGen Jobs and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or opportunities, arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the past 12 months, or ₹1,000, whichever is greater.
9. Indemnification
You agree to indemnify, defend, and hold harmless NexGen Jobs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
10. Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using NexGen Jobs, you consent to our data practices as described in the Privacy Policy.
11. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date and are effective immediately upon publication. Your continued use of the Platform after changes constitutes acceptance of the updated terms. We encourage you to review these Terms periodically.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
We encourage you to contact us first to resolve any disputes informally before pursuing legal action.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
